Additional information

1. All projects involving land use need to be appoved land use demand before the competent level People's Committee decided to allocate land, lease and permit conversion of land use.
2. Competence to allocate land, lease land and permit to converse land use demand:
2.1. Provincial People's Committee decides to allocate land, lease and permit to converse land use demand in the following cases:
a) Allocate land, lease and permit to converse land use demand for organizations.
b) Allocate land for religious institutions.
c) Allocate land for Vietnameses who settle in foreign countries, enterprises with foreign capital as stipulated in Clause 3, Article 55 of the Law on land 2013.
d) Lease land for Vietnameses who settle in foreign countries, enterprises with foreign capital as stipulated point đ and e, Clause 1, Article 56 of the Law on land 2013.
e) Lease land for foreigners held diplomatic functions.
2.2. District People's Committee decides to allocate land, lease and permit to converse land use demand in the following cases:
a) Allocate land, lease and permit to converse land use demand for households and individuals. In case of allocating land, lease agricultural land for households and individuals (not rice cultivation, forest protection, forest land use) for use in commercial, service purpose with the area from zero point five (0.5) hectares or more, it must have the written approval of the Provincial people's Committee before making a decision. b) Allocate land for residential communities.
2.3. Competent authority deciding allocation of land, leasing land and allowing the conversion of purpose of land use mentioned above can not authorize to another authority to do it.
